  1. Identification of the copyrighted work claimed to have been infringed.

  2. Identification of the material that is claimed to be infringing or the subject of infringing activity, and information reasonably sufficient to permit us to locate the material (e.g., a URL).

  3. Contact information for the complaining party, including your name, address, telephone number, and email address.

  4. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  6. Your physical or electronic signature.

You may send your completed DMCA notice to our Designated Agent via email or mail (see contact details above).

3. Counter-Notification

If you believe that content you posted was removed or disabled in error or as a result of a misidentification, you may file a counter-notification. The counter-notice must include:

  1. Your name, address, and telephone number.

  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.

  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

  4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, that you consent to jurisdiction in the District of Massachusetts.

  5. Your physical or electronic signature.

We will forward your counter-notice to the original complainant. If the complainant does not file an action seeking a court order to restrain you from engaging in the infringing activity within 10–14 business days, we may restore the removed material.

4. Repeat Infringer Policy

Elumina Media maintains a policy to terminate, in appropriate circumstances, users who are repeat infringers. We may also remove or disable access to content that appears to infringe copyrights or violate applicable law, at our sole discretion.
